1. Our position on copyright

Pokky Game respects the intellectual property rights of others and expects visitors to do the same. We respond promptly to properly submitted notices of claimed infringement under the Digital Millennium Copyright Act (DMCA), the Indian Copyright Act, 1957 and the Information Technology (Intermediary Guidelines) Rules, and comparable laws elsewhere.

It is worth knowing how this site is built, because it affects most claims we receive. Every game published here is written by us: our own code, our own artwork, our own name for the game. We do not embed or rehost games from third-party servers.

Genre versus expression

Some of our games sit in genres popularised by well-known titles — marble shooters, endless runners, match-three puzzles. Game mechanics and genres are not protected by copyright; specific creative expression is. We deliberately do not reproduce another studio’s characters, logos, level designs, music or branding. If you believe we have crossed that line in a specific instance, tell us exactly where and we will look at it seriously.

2. Filing a notice of infringement

Send your notice by email to dmca@pokkygame.com with “Copyright Notice” in the subject line. We aim to acknowledge within two business days.

To be actionable, your notice must include all of the following. Incomplete notices delay matters for everyone, because we have to come back to you for the missing pieces.

  1. 1Identification of the work. A clear description of the copyrighted work you claim has been infringed. If several works are covered by one notice, a representative list.
  2. 2Identification of the material. The specific material you say is infringing, and enough information for us to locate it — ideally the full URL of the page, plus the game name and where in the game the material appears.
  3. 3Your contact details. Name, postal address, telephone number and email address.
  4. 4A good-faith statement. That you believe in good faith the use is not authorised by the copyright owner, its agent or the law.
  5. 5A statement of accuracy. That the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner’s behalf.
  6. 6Your signature. A physical or electronic signature of the copyright owner or a person authorised to act for them.

Please send notices in good faith

Under Section 512(f) of the DMCA, a person who knowingly makes a material misrepresentation that material is infringing may be liable for damages, including costs and legal fees. If you are unsure whether the material is actually infringing, or whether the use is permitted as fair use or fair dealing, take legal advice first.

3. What we do when we receive a notice

  1. 1We acknowledge receipt, normally within two business days.
  2. 2We review the notice for completeness and assess the claim. Where the claim is clear, we remove or disable access to the material expeditiously.
  3. 3Where the material is our own original work and we believe the claim is mistaken, we will explain our reasoning to you rather than simply removing it — and we will engage with any further detail you provide.
  4. 4We keep a record of the notice and the action taken, for the purposes of our repeat infringer policy.

Removing material is not an admission of liability. It reflects the process the law sets out for intermediaries.

4. Counter-notification

If material of yours was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to dmca@pokkygame.com containing:

  • Your physical or electronic signature.
  • Identification of the material that was removed and the location where it appeared before removal.
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  • Your name, postal address, telephone number and email address.
  • A statement that you consent to the jurisdiction of the appropriate court in the district of your address, or if your address is outside the United States of any judicial district in which we may be found, and that you will accept service of process from the person who filed the original notice or their agent.

Where the DMCA process applies, we may forward your counter-notice to the original complainant. If they do not notify us within ten business days that they have filed an action seeking a court order, we may restore the material.

5. Repeat infringer policy

We terminate access for users who are found to be repeat infringers in appropriate circumstances. Because the site has no user accounts and all published games are our own work, this policy applies mainly to any future feature that allows visitors to submit content, and to abusive or fraudulent use of this notice procedure itself.

6. Trademark concerns

For trademark rather than copyright complaints — for example, if you believe a game name or logo on this site is confusingly similar to a mark you own — write to legal@pokkygame.com with the registration details of your mark, the goods and services it covers, and the specific material you are concerned about. We handle these on the same timeline.

7. Designated contact

All copyright notices and counter-notices should be sent to dmca@pokkygame.com. Please use email rather than post, as it reaches us fastest.

Notices sent to any other address may be delayed. Enquiries that are not copyright matters should go through our Contact page instead.
